High Court clears the way for license renewal of Grameenphone

Feb 13, 2012

The Honorable High Court has issued verdict on VAT and MCF issues regarding the payment of License renewal and spectrum fees this afternoon (February 13, 2012). With this verdict all obstacles for 2G license renewal of Grameenphone has been removed.

According to Court order Grameenphone would not be required to pay the extra BDT 236 crore as MCF for the 7.4 MHZ spectrum obtained in 2008 as demanded by BTRC.

On the VAT issue Grameenphone has been ordered to add VAT on top of license renewal and spectrum allocation fees to BTRC and then deduct at source and obtain rebate. Therefore, BTRC will receive full amount and GP after paying 15% of VAT separately to NBR will be allowed to get 15% rebate on this payment.
The judgment has cleared the confusion over the VAT payment and given clear direction on how the payment will be made.

The verdict has also paved the way of awarding the renewed 2G license and spectrum. According to an earlier judgment by Supreme Court license should be awarded after the issue has been resolved at High Court.  We hope all parties will respect the verdict and act accordingly.
